NPDES Stormwater Permitting
The National Pollution Discharge Elimination System (NPDES) stormwater permitting program regulates point source discharge of stormwater runoff from certain construction sites. Phase I regulates "large" construction activity that disturbes five or more acres of land and Phase II regulates "small" construction activity that disturbs between one and five acres.
The project "operator," or the entity that owns or operates the construction and can ensure compliance, must obtain a NPDES stormwater permit and implement appropriate pollution prevention techniques to minimize erosion and sedimentation and properly manage stormwater. This permit is called the Generic Permit for Stormwater Discharge from Large and Small Construction Activities (CGP). It is important to note that this permit is not the same as the Environmental Resource Permit (ERP) or any other local government's stormwater discharge permit for construction activity.
